Failing to declare the Tax on Stock Exchange Operations (TOB) on time is a common mistake for new investors in Belgium using foreign brokers. The Belgian tax authorities (FPS Finance) are increasingly strict regarding compliance.
The TOB must be declared and paid by the last working day of the second month following the transaction.
Example: If you bought or sold a stock on January 15th, the declaration and payment must reach the FPS Finance by March 31st.
The Fine: €50 per week of delay.
This fine applies per week of delay, capped at a maximum of €2,500 per declaration. This can add up very quickly if you miss several months.
In addition to the fixed fine, you will be charged late payment interest on the amount of tax owed. The annual interest rate is roughly 4% to 9% depending on the current legal rates.

3. Pay on time: Ensure the bank transfer includes the correct structured communication.
Note: If you realized you are late, it is recommended to pay spontaneously as soon as possible. The tax office is often lenient with first-time offenders who self-correct before receiving an official audit letter.
